Medical Marijuana History in Vermont

Senate Bill 76 is the first Cannabis law in the state of Vermont, taking effect on July 1, 2004. It established a registry that provided protection from arrest for patients suffering from a serious or debilitating condition who use medical marijuana. Patients and their primary caregivers can legally possess no more than two ounces of usable cannabis and cultivate no more than three plants, of which only one can be mature.

The SB 76 in July 2007, increased the list of qualifying conditions and increased the allowable amount of marijuana that a person can cultivate to two mature and seven immature plants. Registered physicians from other states were also allowed to recommend marijuana to patients who are residents of Vermont. SB 76 on June 2011, established provisions for up to four state-licensed dispensaries or distribution facilities to serve up to 1,000 patients.

The Vermont Department of Public Safety accepted applications for operation of licensed dispensaries in July 2013. For a patient in the state of Vermont to legally use and cultivate medical marijuana, he must have a recommendation from his registered primary physician and must obtain a registry identification card. A patient can also designate a primary caregiver for assistance. The patient may designate one operating dispensary from which to obtain medical marijuana but can no longer cultivate on his own. A registered qualifying patient and designated caregiver can both have up to two mature plants, seven immature plants and two ounces of usable marijuana. A registered patient can also own marijuana devices like pipes and vaporizers. The regulations for Vermont’s medical marijuana program were most recently updated in 2012. The regulations under Senate Bill 76 cover procedures to provide a certificate of registration to a dispensary and registry identification cards to qualified patients, caregivers, staff of hospice providers and nursing facilities, and employees of dispensaries.
